These Terms of Use apply to your use of www.typical.net and any related subdomains (the “Typical Sites”), and to sales transactions made through the Typical Sites. They also apply to your access to text, images, graphics, software, source code, applications, specifications, audio files, videos, articles, trademarks, logos, product descriptions, and other information or content available through the Typical Sites, including the “look and feel” and arrangement of such content (the “Content”).

The Typical Sites are owned and operated by Typical Goods Inc., doing business as Typical (“Typical,” “we,” “us,” or “our”).

Your use of the Typical Sites and the Content, and your purchase of any products offered on the Typical Sites, is conditioned on your acceptance of these Terms of Use and our Privacy Policy, which is incorporated into these Terms of Use by reference. Please read these Terms carefully.

BY USING THE TYPICAL SITES, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND OUR PRIVACY POLICY.

If you do not accept these Terms, you should immediately discontinue your use of the Typical Sites.

We reserve the right to revise these Terms from time to time by posting an updated version on the Typical Sites without further notice.

THIRD-PARTY SITES

The Typical Sites may contain links to websites and resources operated by third parties. We do not control such websites and are not responsible for their content, products, services, or privacy practices. Your use of third-party websites is governed by their respective terms and policies.

RESTRICTIONS ON USE

The Typical Sites are not intended for minors and may only be used by individuals who are over the age of majority in their country of residence and who are not barred from using the Typical Sites under applicable law.

The Typical Sites are provided solely for personal, non-commercial use. You may use the Typical Sites and the Content only in accordance with applicable laws and these Terms. You agree that you will not:

Use the Typical Sites in any manner not authorized by these Terms;

Resell products purchased through the Typical Sites;

Offer Typical products for sale on any third-party marketplace or sales platform, including but not limited to Amazon, Walmart Marketplace, or similar platforms;

Modify, reproduce, distribute, publish, license, sell, or exploit any Content;

Copy or replicate product descriptions, textile construction details, imagery, or proprietary claims;

Gather, extract, scrape, mine, or otherwise collect data from the Typical Sites;

Use any automated means to access the Typical Sites;

Introduce malicious or harmful material into the Typical Sites;

Attempt to gain unauthorized access to accounts or systems connected to the Typical Sites;

Use any Typical trademarks, logos, or proprietary language without express written consent.

We reserve the right to suspend or terminate access to the Typical Sites at our sole discretion.

INTELLECTUAL PROPERTY

The Typical Sites, including all Content and the arrangement, selection, and look and feel thereof, are the exclusive property of Typical Goods Inc. and/or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

The Typical Stretch Towel™, Don’t Forget to Stretch™, and all related names, slogans, logos, and marks are trademarks of Typical Goods Inc.

Typical’s products incorporate proprietary and patent-pending stretch construction technology. You may not copy, reverse engineer, replicate, deconstruct, or otherwise attempt to derive the underlying textile construction, fabric engineering, or manufacturing methods used in our products.

Nothing in these Terms grants you any ownership or license rights in our intellectual property except for limited personal use as expressly permitted.

If you believe that your copyrighted work appears on the Typical Sites in a manner that constitutes infringement, please notify us at hello@typical.net with sufficient detail for us to investigate.

SUBMISSIONS

If you submit reviews, feedback, comments, images, or other materials (“Submissions”) to Typical, you grant us a perpetual, royalty-free, worldwide license to use, reproduce, publish, adapt, and display such Submissions in connection with our business.

You represent that you own or control all rights to your Submission and that it does not violate any law or third-party rights.

We reserve the right to remove or edit Submissions at our discretion.

YOUR ACCOUNT

If you create an account on the Typical Sites, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

By placing an order, you agree to receive electronic communications relating to your order. Electronic communications satisfy any requirement that communications be in writing.

We reserve the right to disable accounts at our discretion.

TERMS OF SALE

Orders

By placing an order, you offer to purchase the products listed in your order. All orders are subject to acceptance by Typical.

We will send an order confirmation acknowledging receipt of your order. Acceptance occurs when we notify you that your order has been dispatched.

We reserve the right to reject or cancel any order, including if a product becomes unavailable or if we suspect abnormal or unauthorized activity.

Pricing

Prices are displayed in Canadian Dollars (CAD) and U.S. Dollars (USD). Currency conversions may be automatically calculated by Shopify.

Prices are subject to change without notice. You are not entitled to a refund for price changes that occur after placing your order.

Taxes

Applicable sales taxes are added where required by law. You are responsible for any taxes applicable to your purchase.

Shipping and Delivery

We currently ship within Canada and the United States.

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by circumstances beyond our reasonable control, including weather, carrier delays, labor disruptions, or other external events.

Risk of loss passes to you upon delivery to the carrier.

Returns

Returns, exchanges, and warranty claims are subject to our Returns Policy, available on the Typical Sites and incorporated into these Terms by reference.

Nothing in these Terms affects your rights under applicable consumer protection laws.

DISCLAIMERS

The Typical Sites and the Content are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, durability, or fitness for a particular purpose to the extent permitted by law.

We do not guarantee that the Typical Sites will be uninterrupted or error-free.

Product imagery may vary slightly due to screen settings or minor production refinements.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Typical Goods Inc. and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data.

Our total liability to you arising from your purchase of products shall not exceed the purchase price of the relevant product.

Some jurisdictions do not allow limitations on certain damages, so portions of this section may not apply to you.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Typical Goods Inc. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising from:

Your use of the Typical Sites;
Your breach of these Terms;
Your violation of any third-party rights;
Your violation of applicable laws.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.

All disputes arising from or relating to the Typical Sites or these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

If a dispute arises, you agree to first attempt to resolve it in good faith by contacting us at hello@typical.net.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms of Use and our Privacy Policy constitute the entire agreement between you and Typical Goods Inc. regarding the Typical Sites and supersede any prior communications.
